Terms of Use
The agreement between you and LMGT for using Park Hopper.
1. Agreement and acceptance
These Terms of Use are the agreement between you and LMGT covering your use of LMGT Park Hopper, including the website, the app, quests, the Park Passport, badges, XP, Gems, the Gem Vault, Crews, scheduling and any related features.
By creating an account, signing in or taking part in Park Hopper you accept these Terms of Use, the Participant Waiver, the Privacy Policy and the Park Hopper Rules. Those documents are part of this agreement. If you do not accept them, do not create an account or take part.
At sign-up you confirm three things separately: that you are 18 or older, that you accept these Terms and the Waiver, and that you have read the Privacy Policy. Permission to use your shared photos promotionally is a separate, optional choice.
2. Who can take part
The registered account holder must be at least 18 years old. One account per adult.
Children and other household members take part under the adult account holder's Crew. Children do not create accounts, do not have their own profiles and do not sign in.
The adult account holder is responsible for everything submitted from their account, including submissions made on behalf of household members.
3. What LMGT Park Hopper is
LMGT Park Hopper is an independent outdoor discovery and wellness challenge that encourages people to explore parks, move their bodies, discover new places, spend time with others and create meaningful experiences outdoors.
Taking part is free and voluntary. Optional merchandise, if offered, is sold separately and never affects quests, XP, badges, Gems or progress.
4. Independent program notice
LMGT Park Hopper is an independently operated outdoor discovery and wellness program. Unless expressly stated otherwise, LMGT Park Hopper is not affiliated with, sponsored by, endorsed by, administered by, or officially associated with any park, municipality, county, state agency or other governmental entity listed within the platform.
Park names, locations, amenities and other public information are provided for informational and navigational purposes. Park information may change. Verify current hours, closures, fees and rules with the applicable park authority before visiting.
5. Your account
Provide accurate account details and keep them current. Keep your password private, and do not share your account or let anyone else sign in as you.
Tell us promptly if you believe someone else has used your account. You are responsible for activity that takes place through your account.
6. Participation, risk and your own judgment
Participation in LMGT Park Hopper is voluntary. Outdoor recreation involves inherent risks. Participants are responsible for their own safety, supervision of minors in their care, transportation, physical readiness, compliance with park rules and decisions regarding whether conditions are safe for participation.
You decide what is safe for you and your group. Follow posted park rules, closures and staff instructions. Children stay with a responsible adult. Never enter closed or restricted areas to finish a quest.
7. Health and wellness
LMGT Park Hopper provides recreational and general wellness activities and is not medical advice, diagnosis or treatment. Participants should choose activities appropriate for their individual abilities and circumstances.
Outdoor safety
LMGT Park Hopper encourages outdoor exploration, but participants are responsible for determining whether an activity, park, trail, weather condition or physical activity is appropriate for them and members of their group.
Participants should follow all posted park rules, closures, warnings and instructions from park personnel.
Use appropriate caution around traffic, water, wildlife, uneven terrain, heat, storms and other outdoor hazards.
Children must be supervised by a responsible adult.
Never enter restricted, closed or unsafe areas to complete a quest.
No LMGT quest should require trespassing, climbing prohibited structures, disturbing wildlife, removing natural resources or violating park rules.
Safety always takes priority over completing a quest.
9. Park Hopper Rules
The Park Hopper Rules form part of these Terms and are linked at the bottom of this page. They cover honest quest completion, respect for parks and other visitors, supervision of children, and how XP, badges and rewards are handled.
10. How visits are verified
A core park stamp is unlocked with a photo you take at the park plus a simple on-site discovery answer. No location permission is requested, no GPS is used and no coordinates are stored.
Where a sign is missing or changed, or an accessibility, camera or technical issue prevents normal verification, an organiser can approve your completion manually. Use the help link on the verification card.
Submitting false completion evidence, manipulated images or answers obtained without visiting is a breach of these Terms and may result in removal of the related XP, stamps, badges or Gems.
11. Your content
You keep ownership of the photos, reflections and other content you upload. Your uploads are private to your account by default.
When you explicitly choose to share an upload with the community, you grant LMGT a non-exclusive, royalty-free licence to store, display and distribute that content inside Park Hopper so the feature can work. You can un-share it at any time, which withdraws that display.
Using your shared photos in LMGT promotional material requires your separate, optional permission. You can withdraw that permission at any time; withdrawal applies going forward and cannot recall material already printed or published.
Only upload content you have the right to share. Do not upload content that identifies other people without their agreement, or that is unlawful, harassing, hateful, sexual, or invasive of someone's privacy.
12. Acceptable use
- Do not submit fraudulent, duplicated or manipulated quest completions.
- Do not harass, threaten, impersonate or abuse other participants, organisers or park staff.
- Do not scrape, bulk-download, resell or republish Park Hopper content, park data or other participants' content.
- Do not attempt to bypass access controls, probe security, disrupt the service or use automated tools against it.
- Do not use Park Hopper for commercial promotion, recruiting or fundraising without written permission from LMGT.
13. XP, stamps, badges, Gems and Gem Vault items
XP, passport stamps, badges, Gems and Gem Vault collectibles are digital achievements inside the app. They have no cash value, cannot be bought, sold, transferred or exchanged for money, and are not property, unless a specific promotion expressly states otherwise.
LMGT may correct clear technical errors, duplicated awards or fraudulent progress, and may adjust or remove achievements affected by them.
LMGT Park Hopper does not run sweepstakes, raffles, random drawings or other chance-based promotions. Any future prize promotion will publish its own official rules.
14. Suspension and ending your account
LMGT may suspend or end participation for fraud, abuse, harassment, unsafe behaviour, or a material or repeated breach of these Terms or the Park Hopper Rules. Where it is reasonable to do so, we will tell you why.
You can stop taking part at any time and can ask us to delete your account and its contents from the Privacy Choices page. Deleting your account removes your progress, uploads and achievements.
15. Changes to the program and availability
Parks, quests, seasons, events, features and rewards may change, pause or end. Quest availability may change because of park closures, weather, construction, safety concerns or program updates.
Park Hopper is provided as an ongoing service and may be unavailable at times for maintenance, technical problems or reasons outside our control.
16. Disclaimer
Park Hopper is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, LMGT makes no warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose or non-infringement.
LMGT does not warrant that park information, hours, amenities, accessibility details, event details or third-party content are accurate, complete or current. Verify anything that matters with the applicable park authority before you travel.
17. Limitation of liability
To the fullest extent permitted by law, LMGT and the people who operate it are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost data, lost profits or lost opportunity, arising out of your participation in Park Hopper or your use of the app.
To the fullest extent permitted by law, LMGT's total liability arising out of or relating to Park Hopper is limited to one hundred US dollars (US$100), which reflects that participation is free.
Nothing in these Terms limits liability that cannot be limited under applicable law.
18. Indemnity
You agree to indemnify and hold harmless LMGT and the people who operate it from claims, losses, liabilities and reasonable expenses arising out of your participation, your content, your breach of these Terms or the Park Hopper Rules, or the acts of anyone taking part under your account, including minors in your care.
19. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Broward County, Florida, and you and LMGT consent to that venue.
Before starting any formal proceeding, please contact LMGT and give us a reasonable opportunity to resolve the issue informally. Most problems are fixable in a conversation.
20. Changes to these Terms
We may update these Terms. Each version carries a version stamp, shown at the bottom of this page, and that stamp is recorded with your acceptance.
If the Terms change materially, we may ask you to accept the updated version before continuing. Continuing to take part after an update means you accept the current version.
