Participant Waiver, Assumption of Risk & Release of Liability

Please read carefully before participating

Participation in LMGT Park Hopper and Park Hop With LMGT activities is completely voluntary.

1. Assumption of risk

I understand that visiting parks, walking, hiking, exercising, exploring outdoor areas, participating in quests, traveling to and from locations, and other recreational activities involve inherent and other risks.

These risks may include, without limitation, slips, trips, falls, uneven terrain, traffic, water hazards, wildlife, insects, plants, weather, lightning, excessive heat, dehydration, physical exertion, equipment or facility conditions, interactions with other people, and other hazards associated with outdoor and recreational activities.

I voluntarily choose to participate and knowingly assume the risks associated with my participation, to the fullest extent permitted by applicable law.

2. Personal responsibility

I understand that I am responsible for determining whether I am physically and otherwise able to participate safely.

I am responsible for my own safety, health, well-being, transportation, personal belongings, decisions and conduct while participating.

I agree to stop or avoid any activity that I believe is unsafe or beyond my abilities.

LMGT Park Hopper does not guarantee that any park, trail, facility, activity or location is safe or suitable for any particular participant.

3. Park rules

I agree to obey all applicable:

1. park rules and regulations
2. posted signs and warnings
3. operating hours and closures
4. local laws and ordinances
5. instructions from park employees, law enforcement and other authorized officials

I will not trespass, enter closed or restricted areas, disturb wildlife, damage property, remove protected natural resources, or engage in unsafe conduct in order to complete an LMGT quest.

Park rules and safety instructions always take priority over an LMGT quest, challenge, XP, badge, stamp or reward.

4. Weather and conditions

I understand that weather, park conditions, trails, amenities, operating hours, closures and other conditions can change without notice.

I am responsible for checking current weather and park conditions before and during participation.

I understand that LMGT Park Hopper cannot guarantee the accuracy or timeliness of information supplied by third parties or governmental/park authorities.

5. Minors

If I allow a minor to participate through my account or under my supervision, I represent that I am legally authorized to make participation decisions for that minor.

I accept responsibility for appropriately supervising minors in my care.

Children must not be left unsupervised because they are participating in an LMGT Park Hopper activity.

6. Release and waiver

To the fullest extent permitted by applicable law, I voluntarily assume the risks associated with participation and agree to release and hold harmless LMGT Park Hopper, Park Hop With LMGT, Live More with LMGT, and their applicable owners, organizers, employees, contractors, volunteers, sponsors and partners from claims arising from the inherent risks of my voluntary participation, except to the extent such release is prohibited or unenforceable under applicable law.

Nothing in this agreement is intended to waive rights or liabilities that cannot legally be waived.

7. Independent program

I understand that LMGT Park Hopper is an independently operated outdoor discovery and wellness program.

Unless expressly stated otherwise, LMGT Park Hopper is not affiliated with, sponsored by, endorsed by, administered by, or officially associated with any park, municipality, county, state agency or other governmental entity appearing within the platform.

8. Emergencies

LMGT Park Hopper is not an emergency monitoring or rescue service.

Participants are responsible for contacting 911 or appropriate emergency services when emergency assistance is needed.

9. Acknowledgment

By checking the acceptance box and completing registration, I acknowledge that:

1. I have had an opportunity to read this agreement.
2. I understand participation is voluntary.
3. I understand outdoor and physical activities involve risks.
4. I voluntarily choose to participate.
5. I agree to follow park rules and applicable laws.
6. I accept responsibility for myself and minors under my supervision.
7. I understand that this is a legally significant agreement.

Version

This is waiver version participant-waiver-v1. Your acceptance is recorded privately with this version and the date you accepted. If the waiver materially changes, you may be asked to accept the new version.
